AILA Leadership Has Just Posted the Following:
The battle for comprehensive immigration reform is going to be tough as Senate Republicans play politics with the critical immigration issue. The Senate passed its $44.3 billion fiscal 2010 Homeland Security appropriations measure 84-6 last week after three days of debate that differentiated the bill from its House companion on a handful of border security and immigration policies. Unfortunately Senate Republicans used the opportunity to add significant new provisions to the less controversial �extender provisions� including an extension to the Special Immigrant Nonminister Religious Worker Program and the Conrad Waiver Program for Physicians Serving in Underserved Areas. The Senate also included a provision promoted by AILA member Brent Renison to allow the foreign-born widows, children and parents of citizens who have died to retain their legal status to seek citizenship for two years after the death. Sen. Schumer the lead Democrat expects to have a bill ready by Labor Day that is more generous to highly skilled immigrant workers than those who are lower skilled and is tough on future waves of illegal immigration."
Even the Homeland Security Department spokesman Matthew Chandler said the Senate endorsement of Vitter's measure prevents real progress on immigration enforcement and is "a reflection of the old administration's strategy: all show, no substance."
In contrast, the Obama administration is trying to implement effective enforcement, he said. I do not want to renew the advanced payroll, since I do not foresee travel within the next 18 months overseas. Is there a way I can skip the renewal this time around (1-year extension) and renew it the next time? If there is an emergency, I can still go to India and have the Visa-stamped since we have a valid H1/H4 right?

I like the sharpness of the first one better. Normally with water I like blurred/smooth but I think because this shot has nothing BUT water the smooth look isn't working for me.

If you travel abroad when the change is status is pending, the change of status is deemed withdrawn. Pls contact your immigration lawyer, so that he can work with USCIC to get the new I-94 details on the petition.
If the petition was approved before the travel happened, then all that you need to do is to start working and get a visa stamp of H1 when you go out of the country.

Hi,
I was on regular H1B for three years until mid 2008 when I changed to H4 status. Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??

I did it in Ottawa. At that time we could get the visa stamped the same day in Ottawa. Now I think we need to wait for one more day (2 days in all). But make sure you read the Consulate website before proceeding. Different consulates have slightly different procedures.
You have to book the dates for the interview online. Once the date is booked, the Consulate will send you a confirmation letter. You can apply for a Canadian Visitor visa showing this letter.
The Consulate has given a list of required documents. Carry all of them. Also try to get all documents listed on the Chennai consulate too (they have listed more documents), that way you are safe.
Since Canada is almost like the United States, you wont feel that you have reached a strange land. You just feel like you are in another US city!

A recently held Department of Homeland Security program, titled, "2009 Government and Employers: Working Together to Ensure a Legal Workforce" sheds more light onto the types of visits being conducted.

Targeted site visits. These visits take place where fraud is suspected, and consist of a visit to ask questions. Advance notice, including notice to counsel, is supposed to be provided.
Administrative site visits. These relate to religious worker and H-1B petitions (http://www.geelaw.com/lawyer-attorney-1054805.html). They generally are conducted by contractors who know nothing of immigration law. Religious worker visits are performed under the regulations for that category. If you have the LIN number, you can register here:

This will tell you whether the last status was approval, RFE, denial etc. So based on the status, you can know what the letter was really for.

Hi,
I have my Employment based 485 Pending since Aug'2007 (EB-2, priority June'2006, India) and I am currently using EAD for my employment. I am married to a US citizen and have 130 approved on Dec'2008. I want to know what would be my next step.
Can I interfile the pending 485 with the approved 130? or Do I need to file a new 485 and withdraw the pending employment based 485 once I got the new EAD. or Do I need to go for counselor processing?
Please share your experience on this. Any advice will be greatly appreciated.

It seems as if the Big B has not given up on this issue just yet. He is making it a point to mention it atleast once each week, despite what other international developments are going on. I think he will be putting the full court press on the house republicans, it will be interesting to see whether he gets them to accept some compromise.

My gc was filled in nov 2002 from newjersey which has gone to the backlog center in philly....no news after my 45 day letter which i got in june ....
1.I was wonderign if i could change my lawyer now ...and if i could change my gc processing from non rir to rir ?
2.What the odds of changing from non rir to rir?
3.And my gc is filled in eb2 catergory..
4.if i need to change lawyer is it possible?as my lawyer the present one is not exp enough and makes many mistakes ...?

i did searched the posts and apart from one post in that thread i didnt get any satisfacotry answer so i created the post . please do not write that we are not doing our search .
It may depends on the civil surgeon, If +ive PPS is > 1 cm and CS may want you to go thru some medication or clearance from local health department.
